Welcome to CUiT! 🤚 Thank you for using our products and services. This Service is provided by CUiT (PT Mitra Komune Nusantara), located at Equity Tower 37th Floor, Jl. Jend. Sudirman, Senayan, Kebayoran Baru, Central Jakarta, DKI Jakarta Province, Indonesia.

By using our services, you agree to these terms. Our services are very diverse, so sometimes additional terms or product terms (including personal information) may apply. Additional terms are available on the relevant service, and those additional terms become part of your agreement with us if you use that service.

General Terms

These General Terms apply to all members or users who use CUiT. Users hereby agree to be bound by and subject to the Product Terms & Conditions of Use.

Definitions

• Account: an account within the application that a User can use to access and use the Product.
• Force Majeure: includes but is not limited to earthquakes, tornadoes, landslides, floods, fires, explosions, pandemics, natural disasters, war, riots, terrorism, coups, sabotage, embargoes, mass strikes, drastic political/economic changes, and the enactment of new laws and regulations that directly or indirectly affect the implementation of these Terms and Conditions.
• Mission: a form of activity assigned by an admin to a member or user to complete, which may earn points or a reward afterward.
• Point: a form of "bonus/reward" earned by a member or user after completing a certain mission, in numerical form, which can later be used to redeem a Reward.
• Reward: a form of "bonus" earned by a member or user after completing a certain mission, which may be in the form of goods or paid leave.
• Score: the total or cumulative number of points earned by a member/user after completing missions, used for the Award Level Program, where each level has different point and reward requirements.
• Leaderboard: the position of a member or user among other members when completing a certain mission, determined by the number of points held.
• Rank: the position of a member or user among other members when completing a certain mission, determined by the number of points held during a program.
• Content Library: a library of content originating from content created by members or users after completing a Member Generated Content type mission.
• Period: the duration during which a mission can be completed by a member or user.
• Participant: the number of members or users participating in a certain mission.
• Mission Type: the types of missions that can be completed by members or users.
• Mission Brief: specific guidance and a specific description for undertaking an active mission, created by the mission creator or admin.

1. Using Our Services

You must comply with any policies made available to you within our services.

1. You are not permitted to misuse our application. For example, you may not interfere with our services or attempt to access them using a method other than the interface and instructions we provide. You may use our services only as permitted by law, including applicable export and re-export control laws and regulations. We may suspend or stop providing our services to you if you fail to comply with our terms or policies, or if we find improper conduct.
2. Using our services does not give you ownership of any intellectual property rights in our services or the content you access. You may not use content from our services unless you obtain permission from its owner or are permitted by law. These terms do not grant you the right to use any brand or logo used in our services. Do not remove, obscure, or alter any legal notices displayed on or included with our services.
3. In connection with your use of the services, we may send you service announcements, administrative messages, and other information. You may opt out of receiving some of these notices.
4. Our services are available on mobile devices. Do not use those services in a way that distracts you or prevents you from complying with traffic or safety laws.

2. Privacy and Copyright Protection

1. CUiT's privacy policy explains how we treat your personal data and protect your privacy while you use our services. By using our services, you agree that CUiT may use such data in accordance with our privacy policy.
2. We respond to notices of alleged copyright infringement and terminate the accounts of repeat infringers in accordance with the process set out in Indonesian Copyright Law.
3. We protect our intellectual property online. If you believe someone is infringing our copyright and would like to notify us, you can find information on how to submit a notice and CUiT's policy on responding to notices at Our Help Center.
4. You need not worry about data privacy. The data you provide to us will be used appropriately for CUiT's internal needs. All forms of data you provide also remain entirely your personal responsibility. CUiT is not responsible for errors in the data provided.

3. Privacy Policy Updates

1. We may update this Privacy Policy from time to time. When we update this Privacy Policy, we will notify you by updating the "Last Updated" date at the top of this policy and posting the new Privacy Policy or providing other notice as required by applicable law.
2. By continuing to access or use the Platform after the updated policy date, you signify your acceptance of the updated policy. If you do not agree to the updated policy, you must stop accessing or using the Platform.

4. Software in Our Services

1. If a service requires or contains downloadable software, this software may update automatically on your device once a new version or feature becomes available. Some services let you adjust your automatic update settings.
2. CUiT grants you a personal, royalty-free, non-transferable, and non-exclusive license to use the software provided by CUiT as part of the service. This license is granted solely so that you may use and enjoy the benefit of the services CUiT provides, in the manner permitted by these terms.
3. You may not copy, modify, distribute, sell, or lease any part of our services or included software, nor reverse engineer or attempt to extract the source code of that software, unless laws prohibit these restrictions or you have our written permission.
4. Our services are cloud-based business application computing, so you need an internet connection to access them, using a strong and secure internet service provider to avoid any threats.

5. Member and User Data

Your information may be stored on servers using Google Cloud or Cloud Storage services.

1. Customers retain exclusive ownership of all Customer Data. The Customer grants CUiT, for the Term, a non-exclusive, perpetual, worldwide, royalty-free, transferable, assignable, and sublicensable license to use, copy, store, modify, transmit, and display Customer Data to the extent necessary or useful to perform its obligations under this Agreement — specifically to provide and maintain the Software Service, and for no other purpose. The Customer will be responsible for the accuracy, quality, integrity, legality, reliability, appropriateness, and ownership of intellectual property or rights to use the Customer Data.
2. The Customer also grants CUiT a similar license to collect and use Customer Data solely to research, develop, improve, or support the Software Service, provided that such Customer Data is used in an anonymized or aggregated form in which no information can directly identify the Customer, End User, or other data subject. Under no circumstances will CUiT sell or transfer Customer Data to third parties for marketing or advertising purposes.
3. CUiT, at its sole discretion, reserves the right to terminate any access to, delete, process, and/or modify such Customer Data at any time, and to make such Customer Data available to End Users of the Software Service in accordance with the terms of this Agreement.
4. In connection with and for the purpose of providing the Software Service under this Agreement, CUiT will process Personal Data in accordance with the terms of the Data Processing Agreement.

6. Modifying and Terminating Our Services

1. We are constantly changing and improving our services. We may add or remove functions or features, and we may also suspend or stop a service altogether.
2. You can stop using a service at any time, and of course we'll be sad to see you go. CUiT may also stop providing services to you, or add or create new restrictions to our services at any time.
3. We believe you own your data and that preserving your access to such data is important. If we discontinue a service, where possible, we will give reasonable notice and a chance to get information out of that service.

7. About These Terms

1. We may modify these terms or any additional terms that apply to a given service, for example to reflect changes to the law or changes to our services. You should look at the terms regularly. We will post notice of modified terms on this page.
2. If you do not agree to the modified terms for a service, you should stop using that service.
3. If there is a conflict between these terms and the additional terms, the additional terms will control for that conflict. These terms control the relationship between CUiT and you. They do not create any third-party beneficiary rights.
4. If you do not comply with these terms, and we don't take action right away, this doesn't mean we are giving up any rights that we may have (such as taking action in the future).
5. If it turns out that a particular term is not enforceable, this will not affect the other terms. For information about how to contact CUiT, please visit our official page at www.komune.id.

8. Confidentiality of Member and User Data

1. The Receiving Party will use its best efforts to protect the Disclosing Party's Confidential Information from unauthorized disclosure or distribution to Third Parties. The Receiving Party will exercise no less a degree of care in protecting the Disclosing Party's Confidential Information than it does in protecting its own Confidential Information of similar sensitivity and importance, and upon discovery of unauthorized disclosure of Confidential Information, the Receiving Party will use its best efforts to prevent further disclosure or unauthorized use.
2. The Receiving Party agrees to keep confidential all information disclosed under or in connection with this Agreement (whether such information is expressly stated to be confidential or is designated as such), and therefore will not disclose such Confidential Information to any other person or use it for any purpose other than fulfilling this Agreement.
3. Each Party will be responsible for the acts and omissions of its officers, employees, suppliers, and (sub)contractors that result in the unauthorized dissemination, use, and/or disclosure of Confidential Information as if such acts or omissions were its own.
